Who we are

The Lab is run by Not by Accident, an independent studio in Amsterdam (“we”, “us”). These terms apply when you create a Lab account or buy a Lab plan (“you”). Our registered company details, and the law that governs these terms, will be added here before these terms are treated as final.

By creating an account you accept these terms and our privacy policy. If you do not accept them, please do not use The Lab.

Your account

The studio reviews every account before it opens. We may turn down an application, and we may suspend or close an account that breaks these terms, misrepresents who is behind it or puts other members at risk. We tell you when we do.

Give accurate details, keep your password to yourself, and write to hello@notbyaccident.studio if you think someone else has used your account. One account is for one person.

What The Lab does

The Lab helps independent brands see how ready they are for new markets and meet stores, influencers, UGC creators and early adopters, and it helps those members find brands. Scores, reports, market comparisons and matches are guidance, based on what you and other members enter and on the sources described under How it works. They are not a promise of sales, listings, deals or results.

Members make their own agreements with each other. We are not a party to any deal, delivery, payment or collaboration agreed between members, unless we say so in writing.

Plans and payment

What each plan costs and includes is shown on the pricing page. Prices are in euros. Early adopters use The Lab for free.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: it charges you, issues the invoice, calculates any VAT or sales tax at checkout and processes refunds. Paddle’s buyer terms apply to your purchase.

Memberships renew automatically each month or year, depending on the plan, until you cancel.

Cancelling and refunds

Within 15 days of the first payment for a Lab membership you can get a full refund, with no conditions. Market reports, detailed reports and the studio’s other services are made for you and are not refunded once you have asked for them. You can cancel a membership at any time under Settings → Billing; after the first 15 days it runs until the end of the period you paid for. The refund policy sets out the details.

Your content

You keep the rights to everything you add: your profile, products, answers, documents and messages. You allow us to store and process it to run The Lab, and to show the parts you make visible to the members who can see them under your settings.

You are responsible for what you add. It must be yours to share, accurate and lawful.

Using The Lab fairly

Do not copy or collect other members’ details, send bulk or unrelated messages, pretend to be someone else, upload anything harmful, or try to get around the limits of your plan or permissions. Use what you learn about other members only to work with them through The Lab. We may hide content that breaks these rules.

Liability

We build The Lab with care, but we cannot promise it will always be available or free of errors. We are not responsible for what other members say or do, or for decisions you make on the basis of a score, report or match.

Nothing in these terms limits liability that the law does not allow us to limit, or takes away your rights as a consumer.

Ending and changes

You can delete your account under Settings at any time; your data is then handled as the privacy policy describes. If we change these terms in a way that matters to you, we tell you in The Lab before the change applies, and the date at the top of this page changes.
